Don’t Overstate Your Physical Symptoms in a Workers’ Compensation Case

 As a Sacramento insurance fraud case goes to show, it doesn’t pay to overstate your physical symptoms or limitations in a workers’ comp case.

A former CHP officer was sentenced to 180 days in jail and 5 years’ probation after pleading no contest.

The best thing is, to be honest about your symptoms and capabilities – don’t exaggerate but don’t downplay them either.  You only have one body.

  In this article we will take a deeper look at depositions – what they are and their use in workers’ compensation cases. A deposition is a discovery tool which allows the opposing party to gather information regarding the claim. A deposition is basically just questioning and answering questions under oath. While typically in workers’ compensation cases a deposition will be taken of the injured worker, a deposition may also be taken of witnesses and experts such as the doctors, i.e. the treating doctor or the Qualified Medical Evaluator.
